USANZ Gran Fondo Bike Ride Waiver

Bike rider waiver of liability to USANZ

  1. I intend to participate in the bike ride event sponsored by Genesys Care, scheduled to be held on 7 March 2020 in Sydney, NSW (Event) in association with the Annual Science Meeting of the Urological Society of Australia and New Zealand (USANZ).


  2. This waiver applies as between me and USANZ.  It does not limit or affect any rights I may have against any third party.


  3. I acknowledge and agree that USANZ is not responsible for organising or operating the Event.


  4. As between me and USANZ:


    1. I recognise and acknowledge that the Event may involve strenuous physical activity which may carry with it inherent risks and dangers. I recognise that there are risks specifically associated with the Event activities which include, but are not limited to, collisions and contact with other participants and road users, sudden and unexpected changes in weather and physical exertion. I acknowledge that I may incur minor, major or catastrophic injuries, including paralysis or death.


    2. I hereby assume all risks associated with contact with other participants and volunteers, negligent acts of other participants and volunteers, any defects of conditions of road surfaces, failure of cyclists, vehicles, and non-participants to observe traffic signals or laws and/or the effects of weather including high heat, thunderstorms, lightning, rain, cold temperatures, high winds, and/or humidity.


    3. I hereby absolutely release USANZ and its agents, directors, officers, employees, volunteers and representatives from any liabilities, claims, demands and causes of action arising now or in the future for any conditions or injuries I may obtain as a result of my voluntary participation in the Event.  In particular, as the Event is a 'recreational service' for the purposes of the Competition and Consumer Act 2010 (Act), USANZ excludes and gives no guarantees and does not grant any rights to you under Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law as permitted by section 139A of the Act.
